You represent and warrant that you have all rights necessary to grant this license and that your content does not violate any law or the rights of any third party.

7. Disclaimers

The Site and all content are provided on an as-is and as-available basis without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Cobotiq does not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

8. Limitation of Liability

To the fullest extent permitted by law, Cobotiq and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages.

In no event will Cobotiq’s total liability for all claims relating to the Site exceed the greater of one hundred U.S. dollars (100) or the amount you paid Cobotiq, if any, in the twelve months preceding the event giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Cobotiq and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your violation of these Terms or your misuse of the Site.

The Site may reference third-party products, services, or websites. Cobotiq does not control and is not responsible for third-party content, accuracy, or practices.

11. 10DLC Messaging Terms

• No Selling or Sharing of End-User Data: End-user information will not be sold or shared with third parties or affiliates, including for marketing, lead generation, or third-party analytics purposes.
• Opt-In and Opt-Out: Opt-in and opt-out occur through the same 10DLC number used for messaging. A short code opt-out route is not used. Disclosures presented at opt-in are consistent with these Terms and the Privacy Policy.
• Example disclosure for placement near phone input fields: By providing your phone number and opting in, you agree to receive SMS messages from Cobotiq at the number provided.
